Terms & Conditions

**Effective Date: September 5, 2026**

Welcome to ParkPilotHQ.

These Terms & Conditions (“Terms”) govern the use of the ParkPilotHQ platform and services by waterparks, amusement parks, resorts, and other eligible businesses (“Park Owner”, “Customer”, “you”, or “your”).

ParkPilotHQ (“ParkPilotHQ”, “we”, “us”, or “our”) provides cloud-based software and technology services that enable Park Owners to create and manage their own online ticket-booking landing page, connect that landing page to a Park Owner-controlled subdomain, manage bookings, and provide online ticket-booking functionality to their customers.

By registering for, accessing, or using ParkPilotHQ Services, you agree to these Terms.

---

## 1. Nature of ParkPilotHQ Services

ParkPilotHQ is a **technology and SaaS platform provider**.

ParkPilotHQ does not itself operate, own, manage, or control the waterpark, amusement park, resort, or attraction of the Park Owner.

ParkPilotHQ provides software tools that may allow a Park Owner to:

* Create a customer-facing ticket-booking landing page.
* Connect or map the landing page to a subdomain selected by the Park Owner.
* Display park information, ticket types, pricing, offers, operating hours, and other information.
* Receive and manage online ticket bookings.
* Generate booking confirmations, tickets, QR codes, or similar booking records.
* Manage booking-related information through the ParkPilotHQ dashboard.
* Access reports and booking-related information.
* Use supported payment gateway integrations.
* Manage other features made available by ParkPilotHQ from time to time.

The customer-facing landing page created through ParkPilotHQ belongs to and represents the respective Park Owner and is not a general consumer marketplace operated by ParkPilotHQ.

---

## 2. Park Owner's Responsibility

The Park Owner is solely responsible for the information, products, tickets, facilities, and services offered through its ParkPilotHQ-powered landing page.

The Park Owner is responsible for ensuring that all information displayed on its landing page is accurate, complete, current, and not misleading.

This includes, without limitation:

* Park name and description
* Address and contact information
* Ticket prices
* Ticket categories
* Visitor eligibility requirements
* Operating hours
* Holiday schedules
* Offers and discounts
* Terms of entry
* Park rules
* Safety requirements
* Cancellation and refund policies
* Rescheduling policies
* Facilities and attractions
* Availability of services
* Applicable taxes and charges
* Any other information communicated to customers

ParkPilotHQ provides the technology to display such information but is not responsible for the accuracy of information supplied by the Park Owner.

---

## 3. Park Owner Landing Page and Subdomain

ParkPilotHQ may provide the Park Owner with the ability to create a dedicated ticket-booking landing page.

The landing page may be mapped to a subdomain selected or controlled by the Park Owner, subject to technical compatibility and ParkPilotHQ's implementation requirements.

The Park Owner is responsible for:

* Providing accurate domain/subdomain information.
* Maintaining control over its domain.
* Providing any DNS or domain configuration required for mapping.
* Ensuring that the domain is legally owned or controlled by the Park Owner.
* Ensuring that the content published on the landing page complies with applicable law.

ParkPilotHQ may provide technical assistance for domain mapping, but the Park Owner remains responsible for its domain registration and ownership.

ParkPilotHQ may suspend or disable the landing page in accordance with these Terms.

---

## 4. Consumer Ticket Bookings

Tickets are offered and sold by the respective Park Owner through the Park Owner's ParkPilotHQ-powered landing page.

ParkPilotHQ provides the technology used to facilitate the booking process but is not the operator of the underlying attraction.

Accordingly, the contractual relationship relating to the purchase and use of a park ticket is primarily between the **customer and the respective Park Owner**, subject to applicable law.

The Park Owner is responsible for fulfilling the ticket purchased by the customer and providing admission and the associated services represented at the time of booking.

---

## 5. Ticket Prices and Taxes

The Park Owner is responsible for determining and maintaining:

* Ticket prices
* Discounts
* Promotional offers
* Applicable taxes
* Convenience or other charges, where applicable
* Ticket availability
* Ticket validity
* Entry conditions

ParkPilotHQ may provide software functionality for displaying and managing these details but does not determine the commercial terms of tickets sold by the Park Owner unless separately agreed in writing.

The Park Owner must ensure that all displayed prices and applicable taxes comply with applicable laws and regulations.

---

## 6. Payment Processing

ParkPilotHQ may integrate with third-party payment gateways to facilitate online payments.

Where the Park Owner uses its own payment gateway account, the payment transaction is processed through the Park Owner's account with the applicable payment gateway.

ParkPilotHQ does not necessarily receive or hold the customer's ticket payment.

The applicable payment gateway's terms, conditions, privacy policy, settlement rules, and transaction policies will also apply.

ParkPilotHQ is not responsible for:

* Payment gateway downtime
* Bank failures
* UPI failures
* Card-network failures
* Payment authorization failures
* Settlement delays
* Chargebacks caused by the customer's bank or payment provider
* Other failures attributable to third-party payment service providers

---

## 7. Refund, Cancellation and Rescheduling

The **Park Owner is solely responsible for establishing and honoring its ticket cancellation, refund, rescheduling, no-show, and related customer policies**, subject to applicable law.

The applicable refund and cancellation terms should be clearly communicated to customers before completion of the booking.

ParkPilotHQ provides the technology for the Park Owner to manage bookings and may provide functionality for cancellation, refund, or booking modification where supported.

However, ParkPilotHQ does not independently determine whether a customer is entitled to a refund unless expressly agreed otherwise in writing.

Where a refund is approved by the Park Owner, the refund shall be processed in accordance with the applicable payment arrangement and payment gateway procedures.

ParkPilotHQ shall not be responsible for a Park Owner's failure or refusal to provide a refund that is the Park Owner's responsibility.

---

## 8. Park Closures and Operational Changes

The Park Owner is solely responsible for communicating any:

* Temporary closure
* Permanent closure
* Change in operating hours
* Weather-related closure
* Maintenance closure
* Attraction closure
* Safety restriction
* Government restriction
* Special event
* Change in entry conditions

to its customers.

Where a closure or operational change affects an existing booking, the Park Owner is responsible for determining and communicating the applicable solution, including rescheduling or refund where applicable.

ParkPilotHQ may assist with technical booking management but does not control the physical operations of the Park Owner.

---

# 9. ParkPilotHQ Subscription, Booking Charges and Commission

ParkPilotHQ may charge the Park Owner for use of its Services based on the commercial plan or pricing arrangement selected or agreed between ParkPilotHQ and the Park Owner.

Where the Park Owner has opted for a booking-based commission model, ParkPilotHQ may calculate its fees based on the number/value of eligible bookings and the commission percentage selected or agreed with the Park Owner.

The applicable commission slab, percentage, pricing plan, or commercial arrangement may be communicated separately through the Park Owner's onboarding documents, agreement, dashboard, proposal, invoice, or other written communication.

Unless otherwise agreed in writing, ParkPilotHQ fees are separate from the ticket price charged by the Park Owner to its customers.

---

## 10. Monthly Invoicing

For booking-based commission arrangements, ParkPilotHQ may generate an invoice for the Park Owner on a monthly basis.

The monthly invoice may be calculated based on the applicable:

* Number of eligible bookings;
* Booking value;
* Commission percentage;
* Pricing plan;
* Applicable taxes; and/or
* Other agreed charges.

The Park Owner is responsible for reviewing the invoice and paying the invoiced amount within the payment period specified on the invoice.

Unless otherwise agreed in writing, the invoice shall be payable within **15 calendar days from the invoice date**.

---

## 11. Overdue Invoices and Suspension of Services

If a Park Owner fails to pay an undisputed ParkPilotHQ invoice within **15 calendar days from the invoice date**, ParkPilotHQ may, without prejudice to any other rights or remedies available to it:

* Suspend access to the ParkPilotHQ dashboard;
* Disable online ticket booking;
* Disable or temporarily deactivate the Park Owner's ParkPilotHQ-powered landing page;
* Suspend domain/subdomain mapping;
* Disable selected or all ParkPilotHQ Services;
* Restrict creation of new bookings;
* Withhold access to certain platform features; and/or
* Take other reasonable measures to recover outstanding amounts.

ParkPilotHQ may provide notice before suspension where reasonably practicable.

Once all outstanding amounts, applicable taxes, and any other agreed charges have been paid, ParkPilotHQ may restore the Services subject to technical processing and verification.

Suspension of Services does not waive the Park Owner's obligation to pay outstanding invoices.

---

## 12. Effect of Service Suspension on Existing Bookings

If ParkPilotHQ suspends a Park Owner's Services because of unpaid invoices, the Park Owner remains responsible for handling and fulfilling any customer obligations arising from bookings already made.

The Park Owner remains responsible for:

* Customer communication
* Ticket validity
* Entry/admission
* Refunds
* Cancellations
* Rescheduling
* Customer complaints
* Other obligations relating to previously completed bookings

ParkPilotHQ's suspension of the technology platform does not transfer these obligations to ParkPilotHQ.

---

## 13. Taxes

Unless expressly stated otherwise, ParkPilotHQ fees are exclusive of applicable taxes, including Goods and Services Tax (“GST”) or any other applicable statutory taxes.

The Park Owner shall be responsible for paying applicable taxes associated with ParkPilotHQ Services as reflected on the invoice.

The Park Owner is independently responsible for its own tax compliance relating to ticket sales and its business operations.

---

## 14. Customer Information and Data

The Park Owner may receive or access customer information through the ParkPilotHQ platform for purposes related to ticket booking, admission, customer support, business operations, and other legitimate purposes.
